Gambia: David Colley Fails to Appear in Court
Former Director of Prisons, Mr. David Colley, failed to appear in court on Tuesday, June 26th, when the case state prosecutions had brought against him came up for hearing at the Banjul Magistrate’s. Mr. David Colley was abruptly sacked from his position and is now facing several counts of fraud related charges. His defense counsel Antouman Gaye who was in court for the hearing urged the Presiding Magistrate, B.Y. Camara, to strike out the case for failure of the prosecution to bring the accused before the court. Police Prosecutor Touray however told the court that Mr. Colley had been uncooperative with state investigators. It appears that the former director is being helped by friends among the prison staff who are colluding with him to foil the court process. Just like outside prisons, most members of the prison staff, who had been recruited by Mr. Colley sympathize with him and do not believe in the official version of his sacking. Following his sacking The Gambia Journal revealed that it had to do with Mr. Colley’s diary-recording of the disappearance of former Director General of the NIA, Daba Marenah and four others in the wake of last year’s alleged coup attempt against the government of President Jammeh. The official story is that the five men had escaped while being transferred from one prison to the other, but most people take them to be the victims of extra-judicial killing by state agents. Though the Gambia Journal’s report is yet to be independently confirmed, Mr. Musa Suso who was said to have reported Mr. Colley to higher authorities was suddenly pardoned and released from prison where he had been serving a nine-year jail term.
Prosecutor Touray, also told the court that his investigating team could do little since the previous sitting because of Colley’s refusal to cooperate. He added that when his men went to recover the generator the accused was alleged to have stolen, the accused denied knowing anything about the generator.
Magistrate Camara, who presides over the case, told the court that he would issue an order to the IGP and the Attorney- General’s chambers for the accused to be brought in court at the next adjournment date, Thursday 28th June.
